Blue Cross Completed wanted to Inform You: MDHHS COVID-19 Response: Recession of Portions of Bulletin MSA 20-28

On August 12, 2020, The Michigan Department of Health and Human Services issued a Bulletin to rescind portions of Bulletin MSA 20-28 that are specific to provisions of Executive Order 2020-61.

Effective dates of service on or after July 13, 2020, MDHHS rescinds the following sections of MSA 20-28:

Out of state licensed providers

Provisions of MSA 20-28 that temporarily suspended portions of Article 15 of the Public Health Code, Public Act 368 related to out-of-state licensure requirements in response to the COVID-19 public health emergency are rescinded.

Enrollment of ordering providers

The temporary coverage of COVID-19 diagnostic laboratory tests ordered by non-enrolled registered nurses (RNs) and licensed practical nurses (LPNs) working in designated health care facilities is rescinded July 13, 2020.

Supervision, delegation, practice agreements

The temporary suspension of certain provider scope of practice, supervision, and delegation in designated health care facilities described by the executive order is rescinded July 13, 2020. Related Medicaid Practitioner policy is reinstated.

MDHHS indicated that all other provisions of Bulletin MSA 20-28 remain in effect until further notice.
